I assure you that the conservative legal community is going to rally around this theory (it's not a huge departure from the unitary executive stuff they espoused during the Bush years) and, should Trump ever be prosecuted and the case works its way through the federal courts, some conservative judges/justices will sign on.

It's wild how quickly the Federalist Society network can achieve consensus on bizarre legal theories and make them seem well-established. Just look at the ACA cases.

Yeah Trump already made it clear that if Mueller started looking at his financial records then it would cross a red line. Here we go.

Something optimistic (!) from David Dayen

Every time a Democrat (and really only a Democrat) proposes some new idea—free college, a giant tax credit for children or the working poor, a large-scale infrastructure program, even a basic income for every American—both Republicans and the media join in unison with the refrain that the country is broke and we just can’t pay for these priorities. Well, Republicans just found the money for $3 trillion in tax cuts for the wealthiest entities in society. Rolling those back to Obama-era levels creates a $3 trillion kitty for liberal initiatives. If you want college for all or universal health care or retirement security for every American, Republicans just carved out a significant path to doing it while satisfying budget rules and quieting the deficit hawks.

We joked about it earlier, but Mueller getting Person of the Year over Trump would put it over the top

this is a good point. I am also very into the idea of using “dynamic scoring” to justify some good spending based on absurd growth projections.
