i have two super dumb stories this reminded me ...

1. i once bought cayenne in pill form because i heard it was very good for you because snake oil reasons. i took three pills on an empty stomach and spent the next few hours on the verge of emptying my insides

2. i took topical yohimbe + topical cayenne and ran on a treadmill for an hour because i read about its impact on spot reducing. i had to run out of the gym because it felt like my body had been doused in kerosene and lit aflame. i tore off my clothes and screamed in a cold shower for nearly a half hour

i had to call a plumber on sunday morning bc my wife clogged the toilet and it would not work (i don't know anything about this stuff i didn't even realize i could turn the water off with the shut off valve we had propped the floating bulb in the toilet tank up with a can of air freshener

the point is it cost like $360. am i going to see any of that back from my landlord when i send him the invoice? I paid with a personal check

they replaced the fill valve and snaked the toilet. the reason why i'm asking is bc i think i broke the fill valve trying to "repair" it on my own

trying to dig up on the nyc websites if they have to pay

it was a big old poop i guess but the plumber told us they have this low-flow reduction cup in the toilet tank and that is why it's backing up bc not enough water is coming through on each flush.

i think there's blame to go all around on this it would just be nice to get some of this unexpected cash outlay back

the best part is my wife knew it was effed up after her business and didn't say anything until i sit down for my own business at like 1030 pm. brilliant.

when things break in my apartment I call the landlord and they set-up the plumber or whatever. isn't that the normal protocol?

this happened on saturday night

we texted the super but he doesn't work weekends and didn't respond

my mother in law was staying over with us in the apartment so i wasn't about to play toilet martyr here

while i appreciate all the other comments i'm just trying to determine if my landlord has any legal obligation to reimburse me for this unfortunate accident. i wish the nyc websites made this information easy to find but i have done a lot of reading and a lot of googling and am no closer to understanding.

listen if it was just me i could have done fine with a gatorade bottle and figuring out the poops on an ad-hoc basis but it just wasn't in the cards this time

your landlord isn't going to be obligated to pay since you both broke it and started the maintenance on your own. legally there's nothing there for you.

they're required to keep the place habitable but generally on their own terms (eg own contractors/employees), and a couple days isn't going to be enough of a wait to justify calling someone in (i mean it's justified imo but in terms of getting your money back).

that doesn't necessarily mean they wont - my wife dropped a perfume bottle and it shattered the toilet basin and they replaced it, and we have a horrible management company - but i think once you wrote the check you pretty much lost all hope of getting it covered unless they're really cool.

did a quick search (ive done a lot of reading about this stuff for my own issues lol) and i think the relevant info is here:

Under a provision of state law called the "Warranty of Habitability," tenants are entitled to an apartment fit for human habitation without any conditions endangering or detrimental to their life, health, or safety.

Consequently, all tenants, regardless of rent regulation status, are eligible to seek repairs and rent abatements for violations of this Warranty of Habitability. Note, however that your landlord may not be responsible for the COST of repairs if the defects were due to your negligence or the negligence or abuse of someone else in your household. Regardless of whether the landlord or the tenant is ultimately liable for the cost of a repair or maintenance defect, the owner is obligated to keep the premises in good repair.

If your apartment has defects and needs repairs, we generally advise renters to follow the following steps:

Contact your super and/or landlord about the needed repair.
If your superintendent or management company is not being responsive, and the repair has not been made in a timely manner, write a letter to the owner of the building detailing the problem and asking for the repair to be made by a certain date. If the super is simply lax about making repairs, this type of "prompt" to the owner may elicit action. Send the letter by certified mail (read your lease and be sure to follow the requirements for "notices" set forth in the lease) and keep a copy in your files.
If the letter does not bring a response, try to contact the owner in person or by phone. Let him know that resolving the problem is important and that if it is not resolved you will have to file a complaint with the authorities.

Make the needed repair yourself (or hire someone to do it) and deduct the cost from your rent. Be certain that the expense was necessary to correct a violation of the City's Housing Maintenance Code. Also, be careful to get bids for the work and to document both the needed repair and the costs. Bear in mind that this may result in litigation for non-payment of rent. You will need to justify your withholding. Before you take this approach, it is wise to consult legal counsel.
